Please read these Terms and Conditions ("Terms") carefully before booking any tour, trek, safari, or service with Mashuba Tours Ltd("we", "us", "our"). By making a booking or using our website https://www.mashubatours.com(the "Service"), you agree to be bound by these Terms in full.

These Terms apply to all services provided by Mashuba Tours, including Kilimanjaro treks, safaris, day trips, transfers, and any other travel arrangements.

Interpretation and Definitions

Definitions

For the purposes of these Terms:

  • Affiliate means an entity that controls, is controlled by, or is under common control with us.
  • Company refers to Mashuba Tours Ltd.
  • Country refers to Tanzania.
  • Device means any device that can access the Service.
  • Service refers to the Website and our travel services.
  • Website refers to https://www.mashubatours.com.
  • You means the individual or entity accessing or using the Service.

Acknowledgment

These Terms govern your use of the Service and form the entire agreement between you and us. By accessing or using the Service, you agree to these Terms. If you disagree, do not use the Service or make a booking.

Your use of the Service is also subject to our Privacy Policy, which is incorporated by reference.

1. Bookings & Confirmation

A booking is confirmed only upon receipt of a signed booking form (or written/email confirmation) and the required deposit. We reserve the right to decline any booking.

  • Bookings via website, email, WhatsApp, or phone.
  • Confirmation sent within 24 hours of deposit receipt.
  • The lead traveler ensures all party members agree to these Terms and provides accurate details (passport, etc.).

2. Payments

Deposit

A non-refundable deposit of 30% of the total trip cost confirms your booking. Full payment required for bookings within 60 days of departure.

Balance Payment

Balance due 60 days before departure. Late payment may result in cancellation and deposit forfeiture.

Payment Methods

Bank transfer (USD/EUR/GBP preferred), credit/debit card (via Stripe), Western Union. Prices in USD; conversion risk on client.

Tips

Tipping voluntary (guide $15 - 20/day, porter $5 - 8/day recommended).

3. Cancellations & Refunds

Cancellations by You

Cancellations must be in writing to info@mashubatours.com. Charges:

Cancellations by Us

If we cancel (force majeure, minimum group not met, etc.), we offer full refund or credit. No liability for additional costs (flights, etc.).

4. Itinerary Changes

We may modify itineraries for safety, weather, park rules, etc. Guides have final authority. No refund for unused portions due to safety descents (e.g., altitude sickness on Kilimanjaro). Summit not guaranteed.

5. Limitation of Liability

We act as agent/principal for third-party services. To the fullest extent permitted by law:

  • No liability for injury, loss, delay from uncontrollable events (weather, acts of God, third-party failure).
  • Liability capped at amount paid to us.
  • No responsibility for personal belongings.

The Service is provided "AS IS" and "AS AVAILABLE" without warranties. We disclaim all implied warranties. Liability limited to amount paid or $100 if no purchase.

6. Health, Fitness & Safety

  • Assess your fitness; consult doctor for high-altitude treks.
  • Disclose medical conditions; failure may void insurance/safety.
  • Minimum age 10 for Kilimanjaro; under 18 with guardian.
  • Guides carry oxygen/first aid; mandatory descent if unsafe.
  • Follow guide instructions or removal without refund.

7. Travel Insurance

Required for Kilimanjaro treks; strongly recommended for all trips. Must cover high-altitude (to 5,895m), evacuation/helicopter, medical, cancellation, baggage.

We do not provide insurance; no liability for uninsured costs.

8. Passports, Visas & Documents

You are responsible for valid passport (6+ months), visas, etc. No liability for entry issues.

9. Conduct & Environment

Respect guides, communities, wildlife. We may remove disruptive clients without refund. Adhere to Leave No Trace principles.

10. Photography & Marketing

You grant permission to use trip photos/videos for marketing unless you opt out in writing pre-departure.

Links to Other Websites

The Service may link to third-party sites. We are not responsible for their content, policies, or practices.

Termination

We may terminate access immediately for breach of these Terms.

11. Complaints & Disputes

Raise issues during trip with guide/office. Post-trip complaints in writing within 30 days to info@mashubatours.com.

Governed by laws of Tanzania. Disputes subject to Tanzanian courts after informal resolution attempt.

12. Changes to These Terms

We may update Terms; continued use after changes constitutes acceptance. Check website regularly.
